Terms of Service

1. Scope
These terms of service govern the use of Passé — the web app at passe.cc and the Passé mobile app (together, the "Service") — operated by Passé, Franz-Philipp-Straße, 77656 Offenburg, Germany ("we", "us").
By creating an account you agree to these terms.
2. The Service
Passé lets you create trips, attach memories (photos, notes, and locations) to them, and optionally share a public portfolio and public trip pages.
The Service is offered in a free plan and the paid Explorer and Collector plans. The features included in each plan are described in the pricing section of our website and may evolve over time.
3. Your Account
You must be at least 16 years old to use Passé. You agree to provide accurate information when registering and to keep your credentials confidential.
You are responsible for all activity that happens through your account. Notify us immediately at thepasseapp@gmail.com if you suspect unauthorized use.
4. Plans, Payment, and Cancellation
Paid plans are billed monthly in advance: Explorer costs €4 per month and Collector costs €9 per month. Prices include VAT where applicable. Payments are processed by Stripe.
Subscriptions renew automatically each month until cancelled. You can cancel at any time in the billing portal; your paid plan then remains active until the end of the current billing period and is not renewed. There are no refunds for partial billing periods, except where required by law.
If we change prices, we will notify you in advance; price changes apply from the next billing period after the notice.
5. Your Content
You keep all rights to the photos, notes, and other content you upload. You grant us the technical license required to store, process, and display your content for the purpose of operating the Service.
For content you explicitly make public, you additionally grant us the right to display it to visitors of your public portfolio and trip pages.
You are responsible for your content. You confirm that you own the necessary rights to everything you upload and that your content does not violate applicable law or the rights of others.
6. Acceptable Use
You must not:
- upload content that is illegal, infringes intellectual property or privacy rights of others, or depicts people without the right to share their image;
- use the Service to harass, deceive, or harm others;
- attempt to gain unauthorized access to the Service, disrupt its operation, or circumvent plan limits;
- scrape, resell, or systematically extract content from the Service without our permission.
7. Privacy
Your content is private by default and only becomes visible to others if you explicitly make it public. How we handle personal data is described in our privacy policy.
8. Availability
We operate the Service with reasonable care and skill but do not guarantee uninterrupted availability. We may modify the Service; we will not remove core paid features during a period you have already paid for. Please keep your own copies of irreplaceable photos.
9. Termination
You can stop using the Service and delete your account at any time in your account settings. Deleting your account deletes your trips, memories, and photos.
We may suspend or terminate accounts that materially violate these terms, after a warning where reasonable. Statutory termination rights remain unaffected.
10. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. Liability under the German Product Liability Act remains unaffected.
In cases of slight negligence we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place), and only up to the damage that was foreseeable and typical at the time the contract was concluded.
11. Changes to These Terms
We may amend these terms with effect for the future, for example when we add features or when legal requirements change. We will notify you of material changes by email or in the app at least 14 days before they take effect. If you do not agree, you can terminate your account before the changes take effect.
12. Governing Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected.
